Rahat Fateh Ali Khan Property Dispute Gets Major Court Relief

Rahat Fateh Ali Khan has received significant legal relief in an ongoing inheritance-related property case after the Lahore High Court restored his appeal and ordered the matter to be heard on merit.

The latest development in the Rahat Fateh Ali Khan property dispute came after the court set aside a previous decision that had dismissed his appeal over a court fee issue. The ruling has given the renowned singer another opportunity to present his case before the relevant court.

Lahore High Court Restores Appeal

Justice Muhammad Sajid Mahmood Sethi issued an eight-page verdict, allowing the appeal to proceed and directing Rahat Fateh Ali Khan to submit a fine of Rs100,000.

The case revolves around a hereditary property matter involving a double-story house measuring 1 kanal and 9 marlas in Faisalabad. The singer had earlier filed a civil suit seeking confirmation of possession of the property.

A civil court had passed a decree against him in May 2019. Following that decision, Rahat Fateh Ali Khan challenged the verdict through an appeal.

Appeal Was Earlier Dismissed on Technical Grounds

According to court records, the appeal was previously dismissed because the required court fee of Rs15,000 had not been submitted within the specified time.

The singer then approached the Lahore High Court, arguing that the dismissal prevented his case from being properly heard.

After reviewing the matter, the high court observed that rejecting an appeal solely due to non-payment of court fees goes against the broader principles of justice. The court emphasized that legal appeals should not be denied simply because of technical shortcomings.

Court Highlights Importance of Right to Appeal

In its observations, the Lahore High Court noted that the lower court had granted only four days for the submission of the court fee, describing the period as insufficient.

The judgment stressed that the right to appeal is an important legal safeguard and should not be taken away on purely procedural grounds. The court further stated that cases should ideally be decided based on their merits rather than technical defects.

This observation played a key role in the restoration of the appeal in the Rahat Fateh Ali Khan property dispute.

Trial Court Directed to Decide Case Promptly

The Lahore High Court has instructed the trial court to hear and decide the appeal within two months without unnecessary delays.

Additionally, all parties involved in the case, including Rahat Fateh Ali Khan, have been directed to appear before the concerned court on June 2.

With the appeal now restored, the property dispute will move forward for a detailed examination of the facts and legal claims involved in the inheritance matter.
